Moore disclosed that five (5) City Councilors have a potential conflict of interest because they own property within this zone and they are Councilor Rivera, Councilor Lukes, Mayor Petty, Councilor Russell and Councilor Palmieri. The City Solicitor advised City Council that in his opinion, since 5 councilors are prevented from voting and since 8 affirmative votes are required to pass the ordinance, the Conflict of Interest provisions provides that in such circumstances the entire Council can move forward on the matter despite the conflict of interest because it would otherwise stop the body from functioning on the issue. Ordained on a roll call vote of 11 Yeas and 0 Nays. Councilor Rushton moved for reconsideration. Reconsideration Denied on a roll call vote of 0 Yeas and 11 Nays.
