Councilors

Mayor Lukes recognized the presence of a delegation from the Ukraine sponsored by the International Center of Worcester and USAID. They are a group of government officials and nonprofit leaders working on the cultural and historical preservation of their cities and while visiting they will work with the many similar organizations within our community.

Mayor Lukes read a Proclamation declaring May 2009 to be Worcester Community Action Month. Councilor Clancy presented the proclamation to Executive Director of WCAC Jill Dagillis

Recommend that Two Hundred Thousand Dollars And No Cents ($200,000.00) be transferred from Loan Account #91C745, Sewer Construction, and be appropriated to DPW Account #44C764, Sewer Pumping. This will allow for the payment of current and anticipated obligations for the Sewer Pumping Station Capital Program per the cash flow procedure.

Recommend that Four Hundred Thousand Dollars And No Cents ($400,000.00) be transferred from Loan Account #91C745, Sewer Reconstruction, and be appropriated to DPW Account #44C744, Sewer Reconstruction to allow for the payment of current and future obligations per the cash flow procedure.

FROM THE COMMITTEE ON FINANCE - Request City Manager provide City Council with a detailed report concerning the City Council OM expenditures. (Toomey)

FROM THE COMMITTEE ON FINANCE - Request City Clerk work with the Administration to explore alternative ways to conduct the street listing and further, request City Manager recommend a transfer of $33,000 from Election Commission OM account to City Clerk salary account. FROM THE COMMITTEE ON PUBLIC HEALTH AND HUMAN SERVICES - Request City Manager report to the City Council for review, any public health models under consideration.

FROM THE COMMITTEE ON RULES AND LEGISLATIVE AFFAIRS - That the City Council of the City of Worcester approves the following new paragraph and requests that it be added to the Rules of the Worcester City Council 2008-2009 as the second paragraph of the existing Rule 50: Individuals or groups in attendance at City Council meetings may display signs or other advocacy materials or displays in areas designated for public seating or areas of public congregation in the vicinity of the Council Chambers for the duration of any meeting. No sign or advocacy display shall be located on or within the rail in the City Council Chamber, or be permanently affixed to any portion of the building, or be affixed in any manner which might harm or destroy any portion of the building, or shall otherwise disrupt the orderly conduct of any Council meeting.

FROM THE COMMITTEE ON RULES AND LEGISLATIVE AFFAIRS - That the City Council of the City of Worcester approves the following new Rule 43A and requests it be added to the Rules of the Worcester City Council 2008-2009: Rule 43A. No member of the City Council shall communicate using any electronic device with any five or more members of the Council where such communication involves the discussion of any item which is pending before the City Council or which is reasonably likely to be brought before the Council. No member of any committee of the City Council shall communicate using any electronic device with any one or more members of any three-member committee in which he or she is a member where such communication involves the discussion of any item which is pending before the City Council or which is reasonably likely to be referred to the Committee.

FROM THE COMMITTEE ON YOUTH, PARKS AND RECREATION - Request City Manager request Commissioner of Public Works and Parks to arrange to have an independent engineering firm conduct an assessment of the conditions of each of the city of Worcester owned swimming pools and report the findings of the firm to the City Council.

Request City Manager consider allocating Fiscal Year 2010 capital dollars to the effort to replant the Burncoat and Greendale neighborhoods city street trees hardest hit by both the Asian Long-horned Beetle and the December, 2008 ice storm. (Smith, Palmieri)

Request City Manager work with abutters on West Boylston St including the railroad and Saint Gobain along with the city to clean the area of overgrown brush and trash which has negatively impacted the quality of life in that area. (Smith)

Request City Manager consider lengthening the tenure of the constables to 3 years as opposed to the current 1 year term; thus streamlining the process for all involved. (Germain)

Request City Manager provide City Council with a final report regarding the proposed “Worcester Fair-CORI Practices” Ordinance, as attached, which will require all vendors/contractors doing business with the City of Worcester to follow city-established and reasonable guidelines for the use of Criminal Offender Record Information (CORI). Request City Manager request the Commissioner of Public Works and Parks to make adjustments to the traffic lights to alleviate the hazardous conditions, traffic backup and driver frustration when motorists attempt to make a left turn from Shrewsbury St. onto Adams St. (Palmieri, Rosen)

Request City Manager request Commissioner of Public Works and Parks alleviate the hazardous conditions, traffic backup and driver frustration by changing the arrows painted on both directions of May St. at Park Avenue so that the left lane becomes left turn only while the right lane is for both straight-through and right turn traffic. Request City Manager report to City Council concerning what rules and procedures are in place dealing with individuals and groups, including children, who solicit money from motorists at busy and dangerous city intersections. (Rosen)

REPORT OF THE COMMITTEE ON YOUTH, PARKS AND RECREATION Upon the Communication of the City Manager transmitting informational communication relative to a report on the City's Urban Forest: recommend adoption of the accompanying Order that the City Council of the City of Worcester hereby approves the concept as outlined in the City's Urban Forest Report which will guide the city in developing policies that focus on preserving and expanding one of our City's most vital assets.

Amend Section 29 of Chapter 2 of the Revised Ordinances of 2008 relative to the Permit and Inspection Fee Ordinance for the CitySquare Project.

Order of Councilor Michael J. Germain - That the City Council of the City of Worcester hereby accept and adopt Section 19 of the Massachusetts General Laws Chapter 32B, allowing for coalition bargaining for health benefits in the City of Worcester. (Tabled - Lukes October 21, 2008)

Order of Councilor Frederick C. Rushton - Request City Manager request the City Solicitor to report to City Council what basis the City is using to delay the public records request by the Worcester Telegram in light of the Globe Newspaper Company v. Commissioner of Education, 439 Mass. 124 (2003) ruling whereby the Supreme Judicial Court ruled public records must be released for inspection and copying without unreasonable delay, that is, within ten days of the receipt of a request for them. Resolution of Mayor Konstantina B. Lukes - That the City Council of the City of Worcester hereby supports the City Manager in seeking 0% increases in the FY2010 collective bargaining contracts; and be it further resolved that the City Council supports the City Manager in seeking the previously detailed 75/25 contribution rate and the co-pay changes.(Tabled - Haller January 27, 2009)

Motion Haller @ #10d CC - That the City Council of the City of Worcester hereby request the attached Fair Cori Practices Ordinances be allowed to move forward for ordination.

Motion Haller @ #7.34A CM - Request City Manager provide a report of the advertising expenses for all the city departments and the governing ordinances associated with those expenses.

Motion Haller @ #7.42A CM - Request City Manager request the WRTA provide to City Council a detailed report relative to WRTA service levels, resources, routes, passengers and budget for five years ago, ten years ago and the present.

Motion Haller @ #7.42A CM - Request City Manager provide City Council with the minutes of the WRTA Board meetings.

RESOLUTION @ #7.42C CM - That the City Council of the City of Worcester hereby strongly and unanimously go on record in support of the Early Retirement Initiative Home Rule Legislation as well as the extension of City's Pension Funding Schedule in order to greatly assist the City of Worcester with the current fiscal situation.
